Terms of Service — Everyone Eats

Welcome to Everyone Eats. These Terms of Service ("Terms") govern your use of the Everyone Eats subscription service ("Service") operated by Robert Shamblin, doing business as Everyone Eats ("we," "us," or "our"). By subscribing to or using the Service, you agree to these Terms.
1. The Service
Everyone Eats provides personalized weekly dinner planning delivered via email. Each week, subscribers receive a curated set of dinner recipes and a corresponding grocery list, tailored to information provided during onboarding. The Service is a meal planning and recipe curation service. We do not deliver food, ingredients, or physical products.
2. Subscription and Billing
The Service is offered on a monthly subscription basis for $24.99 per month, billed through Gumroad. New subscribers receive a 7-day free trial. After the trial period, subscribers will be automatically charged unless they cancel before the trial ends. Subscriptions renew automatically each month until cancelled.
3. Cancellation and Refunds
You may cancel your subscription at any time by managing your subscription through your Gumroad account. Cancellations take effect at the end of your current billing period. You will continue to receive weekly deliveries through the end of your paid period. We generally do not offer refunds for partial months, though we may issue refunds at our discretion for exceptional circumstances. Gumroad's refund policies also apply and may govern in certain cases.
4. Personalization and Accuracy
The Service uses the information you provide during onboarding to generate personalized meal recommendations. While we make every effort to design meals that reflect your family's stated preferences, allergies, and dietary needs, we cannot guarantee that every recipe will meet every family's specific requirements. You are solely responsible for reviewing all recommendations before purchasing ingredients or preparing meals.
5. Allergy and Dietary Safety
You are solely responsible for the safety of your family's meals. While we take stated allergies and dietary restrictions seriously and design meals with these constraints in mind, you must:
Review each week's recipes before shopping and cooking
Verify all ingredient labels for allergens, cross-contamination, and hidden ingredients
Consult a licensed medical professional regarding any dietary concerns
Never rely solely on Everyone Eats recommendations for medical or life-threatening dietary requirements
We make no representation that our recipes are free of any allergen, cross-contamination risk, or dietary conflict. Ingredients, brands, and formulations change without notice. If you have severe allergies, dietary restrictions, or medical dietary needs, we strongly recommend additional professional guidance.
6. Nutritional Information
Any nutritional estimates provided (calories, protein content, etc.) are approximate and provided for general informational purposes only. Actual nutritional content varies based on specific ingredients, brands, preparation methods, and portion sizes. The Service is not a substitute for medical or dietary advice from a licensed professional.
7. User Content and Communication
By providing information about your family (kids' ages, preferences, allergies, etc.), you grant us the right to use this information to personalize your meal recommendations. We will not share your personal information with third parties except as necessary to operate the Service (see Privacy Policy). You may request deletion of your data at any time by emailing [email protected].
8. Intellectual Property
All content generated by the Service — including recipes, meal descriptions, grocery lists, and email designs — is the property of Everyone Eats. You are welcome to use recipes personally within your household. You may not republish, redistribute, or resell any Everyone Eats content without written permission.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERYONE EATS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO ILLNESS, ALLERGIC REACTIONS, INJURY, OR LOSS OF PROPERTY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify and hold harmless Everyone Eats and its operators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including pricing, features, or content, with reasonable notice to subscribers.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date above and notify subscribers via email of material changes. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Florida.

This Privacy Policy describes how Everyone Eats ("we," "us," or "our") collects, uses, and protects your personal information when you subscribe to and use our meal planning service (the "Service"). By using the Service, you agree to the practices described here.

We also collect payment information through Gumroad. We do not directly store your credit card information; Gumroad handles all payment processing securely on our behalf.
2. How We Use Your Information
We use your information to:
Generate personalized weekly meal recommendations
Communicate with you about your subscription
Improve the Service based on aggregate patterns
Respond to your questions and requests
Process payments through Gumroad
Comply with legal obligations
3. How We Share Your Information
We do not sell your personal information. We do use third-party services to operate Everyone Eats. These service providers process your data on our behalf and are contractually obligated to protect it. They include:
Gumroad — payment processing and subscription management
Tally — onboarding form data collection
Google (Sheets) — customer information storage
Zapier — automation between our tools
MailerLite — email delivery
Anthropic — AI-powered meal recommendation generation
Each of these providers has its own privacy practices. We recommend reviewing their policies if you have specific concerns.
4. Data Retention
We retain your information for as long as you have an active subscription and for a reasonable period after cancellation to handle refunds, disputes, and compliance obligations. You may request deletion of your data at any time (see Section 7).
5. Data Security
We take reasonable measures to protect your information from unauthorized access, disclosure, or loss. All communications are transmitted over encrypted connections. However, no method of data transmission or storage is 100% secure, and we cannot guarantee absolute security.
6. Cookies and Tracking
Our website (built on Carrd) may set standard functional cookies necessary for basic operation. We do not use advertising trackers or cross-site tracking.
7. Your Rights
You have the right to:

Request deletion of your data
Opt out of marketing emails (Note: this differs from cancelling your subscription; see our Terms of Service)
Receive a copy of your data in a portable format

8. Children's Privacy
Everyone Eats is a service for parents. We do not knowingly collect personal information from children under 13. Information about your children (ages, food preferences, etc.) is provided by you as their parent. If you believe we have collected information from a child in violation of applicable laws, please contact us and we will delete it.
9. International Users
Everyone Eats is operated from the United States. If you access the Service from outside the U.S., your information will be transferred to and processed in the United States. By using the Service, you consent to this transfer.
